Quick answer

FVKD Exotics products are sold as hemp under the 2018 Farm Bill, which caps delta-9 THC at 0.3% on a dry-weight basis. Whether they are legal for you depends on your state, city and age, and federal rules are scheduled to change in November 2026. This is general information, not legal advice.

FVKD Exotics products are sold as hemp products under the 2018 Farm Bill, which defines hemp as cannabis with no more than 0.3% delta-9 THC on a dry-weight basis. Beyond that, the answer to “is FVKD legal?” depends on federal law, your state, your city or county, and your age, and every one of those can change.

Federal law is one of the moving parts. A change to the federal hemp definition passed in November 2025 is scheduled to take effect in November 2026, and state legislatures revise their hemp rules often.

This guide is general information, not legal advice. It explains the legal framework in plain English, sets out our own store rules on age and shipping, and shows you how to check the law where you live. For a decision about your own situation, check current law or speak with a licensed attorney in your state.

What the 2018 Farm Bill says about hemp

The 2018 Farm Bill, formally the Agriculture Improvement Act of 2018, defines hemp as the cannabis plant and its derivatives, extracts and cannabinoids with a delta-9 THC concentration of no more than 0.3% on a dry-weight basis. Cannabis above that limit is treated as marijuana under federal law.

The law removed hemp that meets this definition from the federal Controlled Substances Act. It also set up a system in which the US Department of Agriculture oversees hemp production alongside state and tribal plans.

Two parts of that framework matter most for shoppers. First, the definition measures delta-9 THC specifically, not every form of THC. Second, the Farm Bill did not stop states from setting their own, often stricter, rules for hemp products. That is why “sold as hemp” and “legal in your state” are two separate questions.

How THCA fits the hemp definition

THCA products are sold as hemp because the federal definition has measured delta-9 THC, and THCA is a different compound until it is heated. Most of the FVKD range is THCA: seven of the ten product lines we carry.

THCA, or tetrahydrocannabinolic acid, is the acidic form of THC that hemp plants produce. When a vape or a flame heats it, it converts into delta-9 THC through a reaction called decarboxylation. A THCA concentrate can therefore test within the delta-9 limit and still deliver delta-9 THC when it is used.

That gap is why some regulators look at total THC instead. Total THC is commonly calculated as delta-9 THC plus THCA multiplied by 0.877, and a number of states apply a total THC standard to some or all hemp products.

THCA runs through FVKD’s vapes, syringes and pre-rolls alike, from the Monster Cookies Live Rosin THCA Disposable to the Cherry Pie Diamond Infused Hash Holez Pre-Roll. The core legal question is the same across formats.

Does the format matter: vape, syringe or pre-roll?

It can. Some state rules treat vapes or smokable hemp differently from other hemp products, so the same THCA cannabinoid may be handled one way in a disposable vape and another way in a pre-roll.

Format-specific rules can cover who may sell a product, how it must be labeled and packaged, where it may be used and whether it can be shipped. If you are checking your state’s law, search for the format you plan to buy as well as for the cannabinoid, and read both sets of rules together.

What about FVKD's THC-P products?

THC-P products are sold under the same federal hemp framework, but state rules on hemp-derived cannabinoids can reach them differently than THCA, so check your local rules with particular care. FVKD sells THC-P in three lines: the Live Rosin THC-P Disposables, the Crumble THCP Disposables and the Naked Holez THCP Pre-Rolls.

THC-P, or tetrahydrocannabiphorol, is a cannabinoid that researchers first identified in cannabis in 2019, and it occurs naturally only in very small amounts. Some state laws on intoxicating hemp-derived cannabinoids are written broadly enough to cover it, while others name specific compounds, so the answer for THC-P can differ from the answer for THCA in the same state.

The Strawberry Cough Crumble THCP Disposable is one example of the format. To understand how the two cannabinoids differ beyond the law, read our THCA vs THC-P guide.

The federal hemp definition change scheduled for November 2026

Federal law passed in November 2025 changes the federal hemp definition to count total THC, including THCA, and limits intoxicating hemp products, with the change scheduled to take effect in November 2026.

If it takes effect as scheduled, the delta-9-only measurement that THCA products have been sold under would no longer be the federal standard, and intoxicating hemp products would face federal limits. Exactly how that applies to a given product depends on the final legal text, any agency guidance and how the rules are enforced.

What this means for you in practice:

  • Check the date. The rules in force when you read this may differ from the rules on the day you order or use a product.
  • Expect change. Product availability, including what we carry and where we ship, may change as the federal and state picture develops.
  • Use official sources. Federal agency announcements and your state regulator’s guidance carry more weight than any retailer’s summary, including ours.

We don’t predict delays, amendments or court challenges. Read any claim that a hemp product is “federally legal” with this change in mind, and check current federal, state and local law before you buy.

Can FVKD ship to my state?

fvkdvapes.com ships FVKD within the United States to adults 21 and over, with 10 exceptions. We do not ship to Arkansas, Hawaii, Idaho, Kansas, Louisiana, Oklahoma, Oregon, Rhode Island, Utah or Vermont (AR, HI, ID, KS, LA, OK, OR, RI, UT, VT), and we do not ship outside the US.

State Code Do we ship there?
Arkansas AR No
Hawaii HI No
Idaho ID No
Kansas KS No
Louisiana LA No
Oklahoma OK No
Oregon OR No
Rhode Island RI No
Utah UT No
Vermont VT No
Other US states – Yes, to adults 21 and over; check your state and local law first
Outside the US – No

Our shipping policy always carries the current list, and it takes priority over this guide if the two ever differ.

Why is my state on the restricted list?

We keep a restricted list because hemp rules vary widely between states, and some states restrict the kinds of products we sell. The list is store policy; we don’t publish a state-by-state legal analysis, and the list is not a legal opinion about any state.

In general terms, states regulate hemp products in a handful of ways: total THC limits that count THCA, restrictions on intoxicating hemp-derived cannabinoids, limits on smokable hemp or vapes, licensing or registration for sellers, and rules on shipping directly to consumers. Which of these apply where, and how, can change with each legislative session.

My state isn’t on the list. Does that mean FVKD is legal there?

No. Shipping availability is a store policy, not a guarantee that a product is legal where you live. Cities and counties can have their own rules, state law can change between our last policy update and the day you order, and rules on possession and use can differ from rules on sales.

Vape devices can also be subject to federal shipping rules and carrier policies that are separate from hemp law. Our shipping policy explains how we send orders. Check your own state and local law before you buy.

Why you must be 21 or older

We sell FVKD only to adults 21 and over, whatever the minimum age in a buyer’s state. Visitors to our site are asked to confirm they are 21 or older before they browse.

Many states set 21 as the minimum age for hemp-derived THC products, and some also require ID checks at sale or delivery. Please don’t buy FVKD for anyone under 21, share it with minors or leave it where young people can reach it. Our guide on how to store FVKD covers keeping products away from children and pets.

Can you travel with FVKD across state lines?

When you travel with hemp products, the rules of each place you pass through and arrive in apply, not only the rules where you bought them. A product allowed in one state may be restricted in the next, including in the 10 states we don’t ship to.

Air travel adds airport screening and airline rules for battery-powered vape devices, and some states have rules about how cannabis products may be carried in a vehicle. Our storage and travel guide covers carry-on rules and keeping devices out of hot cars. International travel with THC products is outside the scope of this guide.

What a COA tells you about compliance

A certificate of analysis, or COA, is a lab report listing the cannabinoids measured in a specific batch, which makes it the document that connects a product to the legal numbers. FVKD publishes lab results for its products, and each product page in our store links to them.

Three figures matter most for legal purposes. Delta-9 THC is the figure the 2018 Farm Bill uses. THCA shows how much can convert to delta-9 THC when heated. Total THC combines the two, and it is the figure that total THC rules look at. Also check the batch number, lab name and report date so you know the report matches your product.

A COA shows what a batch contained when it was tested; it does not decide whether a product is legal in your state. Compare its figures with the standard your state actually uses. You can find FVKD’s reports, including those for products like the Gods Gift Premium THCA Disposable, on our FVKD lab results page.

How fvkdvapes.com handles compliance as a retailer

We are a retailer of FVKD products, not the official FVKD site, and we run the store on a few fixed policies. You can check each of them before you order.

  • 21+ only: visitors confirm their age on entry, and we sell only to adults 21 and over.
  • US only, with restrictions: no shipping outside the US or to AR, HI, ID, KS, LA, OK, OR, RI, UT or VT.
  • Lab results on every product: each product page links to FVKD’s COA for that product.
  • Disclaimers: product pages carry FDA and Farm Bill disclaimers for hemp products.

FAQ

Questions, answered

Is FVKD legal?

FVKD Exotics products are sold as hemp under the 2018 Farm Bill, which caps delta-9 THC at 0.3% on a dry-weight basis. Whether they are legal for you depends on your state, city and age, and a federal hemp-definition change is scheduled for November 2026. This is general information, not legal advice; check current law.

Can FVKD ship to my state?

We ship FVKD within the US to adults 21 and over, except to Arkansas, Hawaii, Idaho, Kansas, Louisiana, Oklahoma, Oregon, Rhode Island, Utah and Vermont. We do not ship internationally. Shipping to a state is store policy, not a legal opinion, so check your state and local law too. The shipping policy carries the current list.

Is THCA federally legal?

THCA products have been sold as hemp because the 2018 Farm Bill measures delta-9 THC, not THCA. That is changing: federal law passed in November 2025 counts total THC, including THCA, and limits intoxicating hemp products, with the change scheduled for November 2026. States also set their own rules. This is not legal advice.

Do I have to be 21 to buy FVKD?

Yes. fvkdvapes.com sells FVKD only to adults 21 and over, regardless of the minimum age in your state, and visitors confirm their age when they enter the site. Please do not buy products for anyone under 21 or leave them where minors can reach them. Many states also set 21 as the minimum age for hemp-derived THC products.

Is THC-P legal?

THC-P products are sold under the federal hemp framework, but state rules differ. Some state laws on intoxicating hemp-derived cannabinoids cover THC-P broadly, while others name specific compounds, so its status can differ from THCA in the same state. Federal rules are also scheduled to change in November 2026. Check current law; this is not legal advice.

Why won't you ship FVKD to my state?

Hemp rules vary widely, and some states restrict the kinds of products we sell, so we keep a restricted list as store policy. We don't ship to AR, HI, ID, KS, LA, OK, OR, RI, UT or VT. We don't publish a state-by-state legal analysis, and the list can change as laws change. Check your own state law for details.

Where can I check the current hemp law in my state?

Start with official sources: your state department of agriculture, health department, cannabis regulator, attorney general or legislature website. Check whether your state uses delta-9 or total THC, whether it limits vapes or THC-P, and whether your city or county adds rules. Note the date of what you read, and ask a licensed attorney if anything is unclear.
