THCA and state law: how to check before you order
Hemp is defined federally and then regulated state by state. Our restricted list is the floor, not the whole picture, and checking your own state takes about five minutes.
Quick answer
We do not ship to AR, HI, ID, KS, LA, OK, OR, RI, UT or VT. That list is where we will not send at all — other states may still have rules that apply to you. Check your own state before you order. Nothing here is legal advice.
The short version
Federal law sets a definition of hemp. States are free to regulate more tightly, and many do. A product that meets the federal definition can still be restricted where you live.
So the question “is this legal?” has two halves, and only one of them has a national answer. This post is about how to settle the other half for yourself.
Before anything else: nothing on this page is legal advice, and we are not in a position to give any. We are a retailer being specific about what we sell and where we will send it.
The ten states we refuse outright
We do not ship to Arkansas, Hawaii, Idaho, Kansas, Louisiana, Oklahoma, Oregon, Rhode Island, Utah or Vermont. Checkout will not accept a shipping address in any of them, and the restriction is enforced at the point of order rather than discovered later.
That list is maintained as a minimum standard, and it can change. It is not a statement that everywhere else is unrestricted — it is the set of places where we have decided not to ship at all.
We will not help route an order around it. Shipping to a friend in a neighbouring state to forward on is not a workaround we will assist with.
What the federal definition actually says
Federal law defines hemp by reference to its delta-9 THC concentration on a dry weight basis, with 0.3% as the threshold. Material at or below that line is hemp; above it, it is not.
Two things follow that often get missed. The definition is about delta-9 THC specifically, not about every cannabinoid present. And it is measured on a dry weight basis, which is a defined method, not a casual description.
There is also change in the air. A federal amendment to the hemp definition — moving toward counting total THC rather than delta-9 alone — has been scheduled to take effect. We are not going to summarise its status here, because a blog post is exactly the wrong place to learn that. Check a current primary source.
Where to look for your own state
Start with primary sources. Your state’s department of agriculture usually administers the hemp programme, and the state controlled substances schedule tells you what is scheduled. Between those two you can usually establish the position.
State attorney general guidance is often more readable than the statute, and sometimes addresses specific product categories directly.
Be careful with retailer blog posts as a source of current law, including this one. Rules in this area change quickly, and a page written a year ago may describe a position that no longer holds. Use them to know what questions to ask, not to get the answer.
Questions worth asking about your state
Is hemp-derived THCA treated the same as delta-9 THC? Some states have addressed this specifically and some have not.
Does your state regulate inhalable hemp products differently from other formats? Several draw a line at vapes and pre-rolls that they do not draw at other products.
Is there an age restriction, a licensing requirement for sellers, or a restriction on delivery? These can all exist independently of whether the product itself is lawful to possess.
And is anything scheduled to change? Legislation that has passed but not yet taken effect is easy to miss.
What we will not do
We will not tell you whether a specific product is lawful for you to possess where you live. We are not lawyers, we do not know your circumstances, and getting that wrong for you would be worse than declining.
We will not interpret your state’s statute for you, and we will not reassure you that something is fine because we are willing to ship it. Our willingness to ship reflects our own compliance position, not a legal opinion about yours.
What we will do is be precise about what is in the product, publish the lab report for the batch, enforce the age check, refuse the states on our list, and tell you plainly when something is outside what we can answer.
If the position changes after you order
If we cannot lawfully ship an order after it has been placed, we cancel it and refund what was paid for the cancelled items, including any shipping charged for them. That is set out in our returns policy.
If the law changes in your state after a product has been delivered, that is outside anything we can act on, and it is one more reason to check before ordering rather than after.
The documents that govern this
Our terms set out the agreement between us. The disclaimer covers the legal and product disclaimers that apply to everything we sell, including the FDA position on these products. The shipping policy covers where we ship and the conditions attached.
All three are written to be read, not to be scrolled past. If something in them is unclear, ask us — we can explain what a clause means, even where we cannot advise you on your own position.
FAQ
Questions, answered
Which states do you not ship to?
Arkansas, Hawaii, Idaho, Kansas, Louisiana, Oklahoma, Oregon, Rhode Island, Utah and Vermont. Checkout refuses a shipping address in any of them.
Can I have an order sent to a friend in another state?
We ship to the address given at checkout and will not help route an order around a state restriction.
Is anything on this page legal advice?
No. Nothing on this site is legal advice. Check your own state using primary sources, and speak to a lawyer in your state if you need certainty.
Do you ship outside the United States?
No. We ship within the United States only.
What happens if my state changes the law after I order?
If we cannot lawfully ship, we cancel the order and refund what was paid for the cancelled items, including any shipping charged for them.
Why do you ship to some states and not others?
The list reflects our own compliance position on where we are prepared to send these products. It is not a legal opinion about any other state.
